In the context of Jesus' words, even the best defense that human thought can devise is subject to error, omission, and contradiction. Rather than expending time, concern, and resources in preparing such a fallible defense (especially since those assets could more productively -- from God's perspective -- be devoted to serving Him and others), Jesus was telling His followers that God would provide them with the most effective possible words for them to use in their own defense (to the point that He Himself would actually be speaking through them), with no advance preparation needed. This promise was intended to relieve the apostles and disciples of that burden of concern, as well as to increase their faith in God's care for them.

I humbly submit that Jesus was referencing a righteous person who is brought before an immoral corrupted court system on falsehoods. Where the verdict has been rendered prior to any prosecutorial evidence being presented by the prosecutor in that ligation. (Habakkuk 1:4)

DISCERNMENT: The trait of judging wisely and objectively. Basically knowing when to stand defending oneself and when to be obedient to the Holy Spirit by remaining silent and not employing your natural worldly defenses. 

BOTTOM LINE
Jesus discerned and knew the outcome of HIS later show trial before the SANHEDRIN. (Matthew 26: 56-59) And then before PILATE. (Matthew 27:19) Also that the corrupt chief priests and elders would persuade the simple minded who would be shouting "CRUCIFY HIM" (Matthew 27:20)

He choose and then employed the greater weapon of spiritual silence against all these worldly falsehoods. (Matthew 27:14; Mark 15:5)

Our brothers and sisters would go to the lions silently in ROME as mere entertainment for the simple minded of that age. Later a civil European society would legality enforce the extermination of our Jewish branch.

A current age example is the morally innocent dragged before any worldly corrupted legal system in the “you are GUILTY show” trials what we see before our eyes. Where being charged alone means you’re GUILTY.

Danny Hickman Supporter Believer in The Gospel Of Jesus Christ

This isn't an instruction about a legal defense. Jesus is sending his disciples out to alert the world (through Israel as usual) that the kingdom of God is in town. The Word of the Prophets are here in Person! 

But let's get the picture of this straight in our minds. Matthew tells us they were called to Jesus and given the power to cast out demons, heal the sick, cleanse lepers, and even raise the dead back to life. Tell me, should they be considered powerless? No! They are being told to use the power they were given to do for others and not for themselves. They are to be "sheep among wolves." It wasn't that they were without juice. 

Jesus wanted them to get called before the right authorities, to get the attention of the right people. Then he would do the talking. He tells them to not pre-plan a response to the authorities. He tells them 'persecution will come, but don't worry about what you will say when you're arrested, I'll do the talking when the time comes' (Matt 10:19,20). He doesn't want them to panic and appear to be part of a lost cause. He doesn't want them to appear to be afraid. He says, 'what I say to you in private, I want you to proclaim from the rooftops.'(vs 27) In other words, 'we ain't throwing rocks and hiding our hands, we're doing this for all to witness.' 

They don't need a defense strategy. They are out to recruit soldiers for the kingdom. Jesus came to "set a man against his father, and a daughter against her mother..." (vs 35). 

The instructions were for them to go out and tell the world about him being here, and to not worry about the consequences that were sure to come. It wasn't that they were without power; they were to use the power given to them to help others. When they needed help, he would be there to speak for them.
