New Living Bible Translation:

"13 We know that it was Adam’s sin that caused this[a] because although, of course, people were sinning from the time of Adam until Moses, God did not in those days judge them guilty of death for breaking his laws—because he had not yet given his laws to them nor told them what he wanted them to do."

From Genesis 1 until Genesis 12 earthlings operated in opposition to God's eternal plan. In Genesis 12 God chose His newly-formed Nation of Hebrews to carry out His plan and to one day share it with all of humankind, not just Jews. The Jews couldn't handle their assignment. They wanted to do it their way. They had great difficulty identifying the sin in their lives. 

God sent Moses to make that clear. Moses announced the Law. It provided every kind of sin imaginable (especially disobeying God). He said, "OK, you wanna work this thing out, here's the rules. Go for it." 

They didn't. It was impossible for them to obey 1,000 commandments, 613 rules and regulations, and all the oral traditions that the scribes and pharisees in Judaism dreamed up. It got so bad that if you stubbed your toe you were in danger of being excommunicated from Judaism! (Romans 7:7).

So.......... before the Law the people on earth were not judged for their daily sins. Once the Law was in place, they were. 

Thank God He came to earth, manifesting Himself as Emmanuel, God With Us, Jesus, ending the Law and establishing salvation by grace through faith, the GIFT of God, not of works, not of Law, not of duties, rules, obligations (Romans 6:14).......... just His GIFT for those who believe, Romans 10:8-13.

As to Rom 5:12...Because of the Adamic sin, we are all blemished, unjustified, unrighteous in the eyes of God....Rom 3:10...Only Jesus' sacrifice could cleanse us completely as to be acceptable to God.

As to Rom 5:13...In order for you to be guilty of breaking a law, there first has to be an established law to break.

For example, Any speed you travel at on a road without a speed limit will not cause you to break a speed limit law because there is NO speed limit.

The law is what tells us we've sinned...Rom 7:7

If a speed limit is posted on that road and you exceed it, then not only will you KNOW you've broken the law but you will be guilty of breaking it and can be held accountable...

But as to Christians, we are not under the law...Rom 6:14...we are under Grace. So although we may sin, it is not held against us...

Now that doesn't mean that anyone Born of God will deliberately go out and sin as if they have a "Get out of jail free" card

1Jo 3:9 NKJV - Whoever has been born of God does not sin, for His seed remains in him; and he cannot sin, because he has been born of God.

Anyone that does sin deliberately is not a child of God, has not been born again...

1Jo 3:10 NLT - So now we can tell who are children of God and who are children of the devil. Anyone who does NOT live righteously and does NOT love other believers does NOT belong to God.
