At least one commentary suggests that the believer, born of the Holy Spirit, can be 'in the flesh', but this doesn't seem to be at all what Paul is suggesting. The tension that Paul is working with is found all over the New Testament, and it is this--that not all of those who claim to be in Christ are truly born of the Spirit. Those who are truly born of the Spirit will undoubtedly exhibit a Spirit-led life of holiness. All who are born of the Spirit joyfully submit to the Law's demand of pure love to God and neighbor because the Law is holy and Spirit-inspired; the unspiritual person, devoid of the Spirit of God and in the flesh, is not only unable but also unwilling to submit to God who demands obedience from His creatures (the mind is 'hostile' to God). This does not mean that someone who is Spirit-filled will not disobey God and go astray from time to time, but that his or her life (having now been renewed in Christ) is not characterized by hostility to the Law's demand for real spirituality and holiness.

Why does Paul describe the Spirit's working of life in us as a 'law' here? It seems clearer once you read Rom. 7:16-25; there he describes sin as a law working in his body -- sin has rule over him. The 'law' of the Spirit of life that sets us free, then, is not another set of rules to follow but the Holy Spirit's conquering of sin in our hearts, minds, souls, and even bodies. Through this supernatural work of grace that we experience as life in Christ, we fulfill the spiritual demands of the Mosaic law summed up in the love of God and neighbor that no human laboring 'in the flesh' could ever fulfill.

We have also been freed from the external demands of the law so that we might live joyfully before God as we trust in Jesus's completed work on our behalf. These two things -- the inward witness of the Spirit (by which we now cry out to God: 'Father!' where we once had no assurance of His love) and the Father's visible acceptance of Jesus's obedience on our behalf (an acceptance displayed in His resurrection) are great sources of comfort and assurance that we are indeed children of God through our faith, freed from prior condemnation according to His infinite love and mercy. (see also Gal. 2:15-21)
